Buzz Business Boosters Terms and Conditions

 

Effective Date: 4th April, 2024

 

1. Scope of Services

Buzz Business Boosters (“we”, “our”, “us”) provides digital marketing, business consulting, copywriting, website development, and branding services. All services will be outlined in a quote or project brief provided to the client (“you”, “the client”) prior to commencement.

 

2. Client Responsibilities

You agree to:

  • Provide accurate and complete information needed to perform services.

  • Respond to communications promptly.

  • Review and approve work within reasonable timeframes.

  • Ensure any third-party materials you supply (logos, photos, text) are owned or properly licensed.

 

3. Quotes & Approvals

Quotes are valid for 14 days unless otherwise stated. By confirming a quote via email or written message, you accept the scope, pricing, and these Terms & Conditions.

 

4. Payment Terms

  • A 40% deposit is required before work begins, unless otherwise agreed.

  • The remaining 60% is due upon project completion or as outlined in your invoice or project schedule.

  • Invoices are payable within 7 days of issue, unless agreed otherwise.

 

5. Late Payments & Non-Payment

  • Overdue invoices will incur a $15 administration fee and 2.5% monthly interest on the outstanding balance.

  • If payment is not received after 14 days, we reserve the right to:

    • Suspend or withhold delivery of any services or materials.

    • Refer the account to a debt recovery agency.

    • Add all associated collection and legal fees to the outstanding amount (where permitted by law or agreed in advance).

  • Copyright of any work produced remains with Buzz Business Boosters until payment is received in full.

 

6. Cancellation & Refunds

  • If you cancel after work has commenced, you are liable for the proportion of work completed and any costs incurred to date.

  • Deposits are non-refundable once work has begun.

  • If we cancel the agreement due to unforeseen circumstances or inability to deliver, any unused deposit will be refunded in full.

 

7. Revisions & Approvals

You are entitled to up to two rounds of revisions per deliverable unless otherwise agreed. Additional changes will incur an hourly fee.

You are responsible for final proofreading and approval before publishing or printing.

8. Intellectual Property

  • Upon final payment, ownership of custom deliverables (text, designs, strategy documents) is transferred to you.

  • We reserve the right to display completed work in our portfolio or promotional materials unless otherwise agreed.

  • Tools, templates, and methodologies developed by us remain our intellectual property and may be reused in future work.

 

9. Confidentiality

We will keep confidential all sensitive information shared in the course of our work unless required by law or authorised by you in writing.

 

10. Liability

We make no guarantees of specific results unless expressly stated in writing. We are not liable for:

  • Losses due to third-party services (hosting, platforms, social media changes, etc.)

  • Delays caused by the client’s failure to meet obligations.

  • Errors in final deliverables that were approved by the client.

Our liability is limited to the total fees paid for the services rendered.

 

11. Dispute Resolution

  • If a dispute arises, both parties agree to attempt resolution through informal negotiation first.

  • If unresolved, the matter may be escalated to mediation in accordance with Australian Small Business and Fair Trading law.

  • Legal proceedings will only be pursued as a last resort.

 

12. Force Majeure

We are not liable for delays or failure to deliver due to events beyond our control (e.g., natural disasters, illness, power outages, internet disruption).

 

13. Amendments

We reserve the right to amend these Terms at any time. Updated terms will be posted on our website. Continued use of our services constitutes acceptance of any changes.

 

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
